Steps to Become a Remote Online Notary

  1. 1. Commissioned Notary: Ensure you are a valid Pennsylvania notary public. If not, apply through the Pennsylvania Department of State.
  2. 2. Notify the Department of State: Submit the Remote Notarization Notification Form online, specifying the communication technology you intend to use.
  3. 3. Select Approved Technology: Choose a communication platform from the Department’s list of approved vendors.
  4. 4. Set Up Your Technology: Register and configure your chosen platform to meet all state requirements, including identity verification and recording capabilities.
  5. 5. Update Your Notarial Certificate: Modify your certificate to include the statement: “This notarial act involved the use of communication technology.”
  6. 6. Begin Performing Remote Notarizations: Once approved, start offering your RON services to clients.
  7. 7. Maintain Compliance: Keep all audio-visual recordings and electronic records for at least ten years and stay updated with any regulatory changes.

Requirements for Remote Notarization

Important: Notaries must notify the Pennsylvania Department of State and use approved technologies before performing remote notarizations.

Submit the online notification form specifying the communication technology you plan to use. No additional fees or training are required at this stage.

Use of Approved Communication Technology

The technology must meet the following criteria:

  • Enable simultaneous audio and visual communication with the signer.
  • Allow for identity verification through personal knowledge, credible witness testimony, or at least two identity-proofing methods (e.g., Knowledge-Based Authentication, biometric verification).
  • Ensure that the electronic record or signature is tamper-evident.
  • Create and retain an audio-visual recording of the notarization session for at least ten years.

Note: Platforms like Skype, Zoom, and FaceTime are NOT acceptable for remote notarizations.

Modified Notarial Certificate

Include the following statement in your notarial certificate:

“This notarial act involved the use of communication technology.”

Location Requirements

The notary must be physically located in Pennsylvania during the notarization. The signer can be anywhere, but the notarization must relate to records used in U.S. courts, property in the U.S., or transactions connected to the U.S. Additionally, foreign signers must comply with their local laws.
